The Occupational Health and Safety Act (OHSA) (Act 85 of 1993) regulates health and safety in the workplace in South Africa.

The OHSA is applicable to all employers in the Republic and covers the full spectrum of employment, from self employed individuals to large corporate organizations, from the home bakery to the largest engineering enterprises, as well as practices (lawyers, doctors, architects), offices, retail businesses, schools, churches, golf clubs, shopping malls and factories. The list goes on and on until EVERYONE is included.

Occupational Health and Safety is a strategic business decision: always made and driven by top management. Ideally it should be part of the values of the company, e.g.:
  • cherishing the wellbeing of employees, clients and other stakeholders; and
  • adhering to the laws of the country

Should the company not have the necessary skills in-house, the decision to contract out the implementation of an OHS program is a logical next step.

Few employers are aware of their obligations in terms of the OHSA - therefore the content of what should be in place is even less well-known
